About Fork Fit Fork Fit (forkfit.health) is an AI-powered personalised meal planning service operated by Jake Chisholm, ABN 87 687 307 491, trading as Fork Fit ("we", "us", "our"). Fork Fit generates personalised meal plans, recipes, shopping lists, and nutritional information using artificial intelligence. By accessing or using the service, you agree to be bound by these Terms of Service. ## 2. Acceptance of terms By creating an account, accessing, or using Fork Fit, you confirm that you: - Are at least 18 years of age - Have the legal capacity to enter into these terms - Agree to be bound by these Terms of Service and our [Privacy Policy](/privacy.md) If you do not agree to these terms, you must not use the service. ## 3. Accounts and eligibility To use Fork Fit, you must create an account with a valid email and password. You are responsible for: - Maintaining the confidentiality of your login credentials - All activity that occurs under your account - Notifying us immediately of any unauthorised access Accounts are for individual use only and may not be shared or transferred. We may suspend or terminate accounts that violate these terms. ## 4. Free trial and subscription Fork Fit offers a **14-day free trial** to new users. During the trial you have full access to all features including: - 18 personalised AI-generated recipes (6 breakfast, 6 lunch, 6 dinner) - Meal vault with phase system and quick swaps - Food diary, weight tracker, and smart shopping lists Subscription fees apply at the price displayed on the Fork Fit pricing page at the time you subscribe, in Australian Dollars. We may modify pricing with 30 days' notice to existing subscribers. Price changes take effect at the start of your next billing cycle. ## 5. Billing, payments and refunds Payments are processed securely through Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring monthly basis. - All prices are in **Australian Dollars (AUD)** unless otherwise stated - Billing occurs on the same date each month from your subscription start - Failed payments may result in service interruption We do not store your credit card details — all payment information is handled directly by Stripe in accordance with PCI-DSS standards. ### Refunds As Fork Fit provides access to AI-generated digital content immediately upon payment, refunds are generally not available under Australian Consumer Law for change-of-mind purchases. However: - If the service has a major fault or is substantially different from what was described, you are entitled to a refund under Australian Consumer Law - Refund requests should be made within 7 days of the relevant charge - Contact `hello@forkfit.health` for any billing concerns ## 6. Cancellation You may cancel your subscription at any time. Upon cancellation: - You retain access until the end of your current billing period - No further charges will be made - Your meal plan data remains accessible in read-only mode for 30 days after your subscription ends - After 30 days, your data may be permanently deleted ## 7. AI-generated content **Important**: Fork Fit uses artificial intelligence (Anthropic Claude) to generate recipes, meal plans, and nutritional estimates. AI-generated content may contain errors, inaccuracies, or omissions. You acknowledge and agree that: - Recipes, calorie counts, macronutrient values, and portion sizes are **estimates only** and may not be perfectly accurate - AI-generated meal plans are not reviewed by a human nutritionist, dietitian, or medical professional before being delivered to you - Ingredient lists may not capture all potential allergens — always verify ingredients yourself if you have allergies or intolerances - Cooking times, temperatures, and methods are suggestions — use your own judgement for food safety - We continuously improve our AI prompts and outputs, but cannot guarantee error-free content ## 8. Health and nutrition disclaimer ### ⚠️ Important health notice Fork Fit is a **meal planning tool**, not a medical service. The information provided through Fork Fit — including recipes, calorie targets, macronutrient breakdowns, weight tracking insights, and calorie adjustment suggestions — is for **general informational and educational purposes only**. **Fork Fit does not provide medical advice, diagnosis, or treatment.** By using Fork Fit, you acknowledge and agree that: - **Not a substitute for professional advice**. Fork Fit's content is not a substitute for advice from a qualified healthcare provider, doctor, dietitian, or nutritionist. - **Allergies and intolerances**. AI-generated recipes may still contain allergens or cross-reactive ingredients. If you have severe allergies, coeliac disease, or other serious food intolerances, verify every ingredient before consuming. - **Pre-existing conditions**. If you have diabetes, kidney disease, heart disease, eating disorders, or any other condition affected by diet, consult your doctor before following any plan generated by Fork Fit. - **Pregnancy and breastfeeding**. Fork Fit is not designed for pregnant or breastfeeding individuals. Consult your healthcare provider for dietary guidance. - **Weight and calorie guidance**. Calorie targets, weight tracking insights, and adaptive calorie suggestions are algorithmically generated and may not be appropriate for your specific circumstances. - **Food safety**. You are solely responsible for ensuring food is stored, prepared, and cooked safely. - **No liability for health outcomes**. We are not liable for adverse health effects, allergic reactions, illness, injury, or other harm resulting from your use of Fork Fit content. **Our recommendation**: If you are unsure whether Fork Fit is appropriate for you, consult a qualified healthcare professional before using the service. Your health and safety are your responsibility. ## 9. Acceptable use You agree not to: - Use Fork Fit for any unlawful purpose - Attempt to reverse-engineer, scrape, or extract our AI prompts, algorithms, or proprietary systems - Share your account credentials or allow multiple users on one account - Resell, redistribute, or commercially exploit Fork Fit's generated content without permission - Interfere with the operation of the service or attempt unauthorised access - Use automated tools, bots, or scripts to interact with the service ## 10. Intellectual property The Fork Fit brand, logo, interface design, and underlying software are owned by us and protected by intellectual property laws. AI-generated recipes and meal plans are provided for your **personal, non-commercial use**. You may save, print, and share individual recipes with friends and family, but you may not republish, resell, or commercially distribute them. ## 11. Privacy and data Your privacy matters. Our collection, use, and handling of personal information is governed by our [Privacy Policy](/privacy.md), which forms part of these Terms. ## 12. Limitation of liability To the maximum extent permitted by Australian law: - Fork Fit is provided **"as is"** and **"as available"** without warranties of any kind - We do not warrant the service will be uninterrupted, error-free, or free of harmful components - Our total liability for any claim is limited to the amount you paid in the **3 months** preceding the claim - We are not liable for any indirect, incidental, special, consequential, or punitive damages Nothing in these terms excludes or limits any rights you have under the **Australian Consumer Law** that cannot be excluded by agreement. ## 13. Indemnification You agree to indemnify and hold harmless Fork Fit, its operator, and its affiliates from any claims, liabilities, damages, losses, and expenses arising from: - Your use of the service - Your breach of these terms - Any health or dietary decisions you make based on Fork Fit's content ## 14. Termination We may suspend or terminate your account at any time if you breach these terms, with or without notice. Upon termination: - Your right to use the service ceases immediately - We may delete your data after 30 days - Provisions that should survive termination (liability limitations, indemnification) will survive ## 15. Changes to these terms We may update these Terms of Service from time to time: - We update the "Last updated" date - We notify you via email or in-app notice for significant changes - Continued use after changes constitutes acceptance ## 16. Governing law These Terms are governed by the laws of **Queensland, Australia**. Disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia. ## 17.
